WHAT IS THE OPPORTUNITY?

City National Bank seeks a motivated and team-oriented attorney to assist with all aspects of discovery for the bank’s litigation, investigations, and third party legal process, including responses to civil and criminal subpoenas, government investigations, search warrants, law enforcement requests, and writs of execution.

The candidate will also provide oversight for legal processing staff and will support other in-house lawyers with CNB’s internal discovery process.

The ideal candidate will be familiar with eDiscovery best practices, electronic data collection and production, legal holds, and document review procedures.

The candidate will also have a strong background in subpoena processing and experience working with cross-functional teams, including IT, HR, and customer facing business units, to respond to discovery and legal process.

The candidate will also support the other in-house attorneys in various litigation matters, including case management and oversight of outside counsel.

WHAT WILL YOU DO?

Assist with reviewing, analyzing, and responding to discovery-related requests.
Provide legal advice on discovery requirements for litigation and third party legal process.
Provide advice and counsel with respect to legal requirements relating to subpoenas and other legal process received by CNB, including writs and levies.
Act as primary point of contact for opposing counsel with respect to subpoenas and other types of legal process.
Assist with CNB’s legal hold processes and document preservation efforts.
Act as a stakeholder in CNB’s strategy and development of its playbook and operational plans to preserve, review and produce data.
Manage and conduct document reviews for responsiveness, privilege, relevance, and discoverability.
Act as a primary point of contact for discovery-related vendor and outside counsel relationships.
Prepare and implement CNB’s eDiscovery policies, strategies, and workflows.
Support other in-house counsel on general litigation matters.
Assist with special projects as needed.
Provides counsel and assistance to management of the Bank and other colleagues with respect to legal matters which include research, preparing opinions, and drafting documents.
Partners with business units and support groups (e.g., compliance, product, marketing, lending units, and risk management) to provide effective and efficient legal, transactional and regulatory guidance.
Identifies regulatory and legal gaps within area of expertise and assists in addressing such gaps.
Supports senior attorneys as needed.
May supervise outside counsel on assigned legal matters.
Responsible for certain administrative or operational functions within the Legal Division.
Complies fully with all Bank policies and procedures, including the Colleague Code of Conduct, as well as all legal and regulatory requirements.
Completes all required training.

WHAT DO YOU NEED TO SUCCEED
Must-Have*
JD (Juris Doctor) Admission to the California State Bar (or eligibility to register as in-house counsel in California) required
Minimum of 5 years of relevant experience at a law firm or in-house legal department, including experience with document reviews, subpoenas, and eDiscovery review platforms.
Skills and Knowledge
Deep understanding of the attorney-client privilege and attorney work product protections.
Be well versed in state and federal laws and regulations governing the assigned area(s) of responsibility, banking environment, and related industry practices.
Demonstrated experience in analyzing, interpreting and communicating strategies and requirements, and the ability to translate complex legal requirements into written materials and oral presentations.
Must have excellent problem solving abilities and effective verbal, written and executive communication and presentation skills.
