Position Information

This is a full-time management (MPP) position in the Student Affairs Division. MPP employees serve at the pleasure of the campus President. MPPs do not serve a probationary period and never receive permanent status.

This position is a “designated position” in the California State University’s Conflict of Interest Code. The successful candidate accepting this position is required to file Conflict of Interest forms subject to the regulations of the Fair Political Practices Commission.

Satisfactory completion of a background check (including a criminal records check) is required for employment. CSU will make a conditional offer of employment, which may be rescinded if the background check reveals disqualifying information, and/or it is discovered that the candidate knowingly withheld or falsified information. Failure to satisfactorily complete the background check may affect the continued employment of a current CSU employee who was conditionally offered the position.

The person holding this position is considered a `mandated reporter’ under the California Child Abuse and Neglect Reporting Act and is required to comply with the requirements set forth in CSU Executive Order 1083 as a condition of employment.

Major Duties

Under the general direction of the Associate Vice President of Student Life/Dean of Students, the Director of Student Conduct is responsible for day-to day administration of student disciplinary procedures for the entire campus. The incumbent supports student learning and personal development by promoting ethical conduct and responsible behavior to students, and by initiating appropriate sanctions to address behaviors that violate the campus Student Conduct Codes. The Director of Student Conduct receives and investigates complaints, adjudicates complaints in accordance with campus, CSU policies and procedures, and insures that due process is afforded to students. The Director of Student Conduct proposes policies and implements procedures that insure the timely resolution of conduct issues; assists in mediating disputes; develops materials that communicate campus procedures and expectations concerning student conduct; and develops and maintains direct contact with campus departments. The Director of Student Conduct has responsibility for campus-wide training and education for judicial issues and works closely on health and safety concerns of campus students.

The Director of Student Conduct provides leadership and supervision to the Office of Community Standards. The incumbent is responsible for the development and maintenance of robust case management system designed to provide students with holistic support.

Qualifications

Required Education & Experience:

Minimum of five to eight (5-8) years of directly related experience dealing with student conduct processes on a college campus; ability to counsel and advise students on their rights and responsibilities as it relates to due process and experience supervising full-time professional and/or administrative staff.

A Bachelor’s degree in Public or Business Administration, Counseling or Counseling Psychology, or closely related field.

Knowledge, Skills and Abilities:

Knowledge of:

Incumbent should possess general knowledge of the principles, practices and trends of the Student Services field as well as general knowledge of the policies, procedures and practice of student conduct; knowledge of basic counseling, risk assessment and handling crisis situations; understanding and knowledge of federal and state legislation regarding student conduct in higher education.

Abilities to:

The ability to analyze complex situations accurately and adopt effective courses of action; train and educate faculty, staff and students on trends and issues in student conduct with a focus on proactive education; ability to interpret and evaluate complex situations and cases brought forward by faculty, administrators, departments or individuals; ability to carry out a variety of professionally complex and confidential assignments without detailed instructions; and to establish and maintain cooperative working relationships with a variety of departments and individuals. Supervise and evaluate the work of others.

Skill in:

Skills in working with campus administrators, faculty, staff and students to address complex issues and situations; strong critical thinking skills and analytical skills; ability to investigate observe, and resolve multiple complex issues and situation in a timely manner; ability to handle potentially volatile situations and ability to maintain objectivity skills in coordinating interventions and working with students in crisis; skills in presenting, training and developing workshops; organizing complex programs and attention to detail; working with students individually and in groups; and collaboration with the campus community

Preferred Qualifications:

Five (5) years in student services work; knowledge of legal issues facing higher education; knowledge of federal legislation impacting student conduct such as FERP A, HIPAA and the Clery Act; knowledge of student conduct databases; understanding of alternate forms of dispute resolution such as mediation and/or restorative justice.

Responsibilities

40% – Program Development and Administration
– Develop and proposes procedures and protocols necessary for the day-to-day administration of student disciplinary processes.
– Identifies the need for and assists in developing campus policies that promote compliance with the Student Code of Conduct, CSU policies on student discipline, and relevant state and federal laws.
– Works with and consults with University Housing staff on student conduct issues
– Establishes procedures for communicating imposed sanctions to Admissions and Records and Police Services as appropriate.
– Develops and maintains student discipline records. Generates and maintains statistical reports and reports data to Police Services as necessary to comply with Clery Act reporting guidelines.
– Regularly meets with and maintains strong and mutually supportive relationships with Student Health and Psychological Services for the purposes of referring students who are exhibiting emotional problems or who have been referred to counseling as a condition of continuing enrollment.
– Develop and maintain relationships with Police Services to adjudicate discipline referrals, coordinate the handling of cases that are also subject to criminal proceedings, enforce interim suspensions and denial of consent to enter campus, and responds to calls for emergency assistance.
– Confer with the Associate Vice President for Human Resources on complaints alleging discriminatory harassment as needed.
– Further communicate with Information Technology administrators on violations related to computing use by students.
– Analyzes trends in campus misconduct and other areas of student life, anticipates areas of concern, and proposes appropriate strategies.
– Provide clear direction to office staff in handling confidential files and preparing follow-up correspondence. Represent CSUDH at annual meeting of CSU Judicial Officers and CSU trainings related to investigation practices, updates to Title V and pertinent CSU Executive Orders.
– Supervise and evaluate Ethical Development Coordinator, and Administrative Support Coordinator in the Office of Community Standards.
– Ensure direct reports have professional development plans, detailed case management files, and review and assess annual goals. Provide feedback on strategic initiatives.
Provide crisis intervention and advocacy for students, faculty and staff and provide resources and referrals on various concerns.
– In collaboration with the Ethical Development Coordinator of the Office, develop and implement an outreach plan designed to build relationships and help to educate the student community about the student conduct code and responsible behavior.
– Utilize a variety of strategies to educate students on issues of ethical behavior, academic integrity and student rights and responsibilities.
– Develop materials and strategies to educate faculty and staff about student discipline procedures, managing disruptive behavior, faculty options in responding to academic dishonesty, student rights and responsibilities, and confidentiality of student records.
– Makes individual and group presentations to faculty, staff and students to provide training and answer questions related to student conduct and ethical behavior.
– Coordinates educational workshops and oversees referrals to Student Health and Psychological Services required to fulfill judicial sanctions

40% – Adjudication of Violations of Student Code of Conduct

– Interpret and apply Title V of the California Education Code Section 41301 (Standards for Student Conduct) and CSU Executive Orders which govern student conduct processes to ensure due process and confidentiality in procedures.
– Receive written and oral complaints from faculty, staff and students and the community concerning acts of student misconduct. Insure due process by notifying student of the allegations made against them.
– Clearly communicate conduct issues to students verbally and in writing during meetings and follow-up correspondence. Conduct unbiased investigations to gather evidence and carefully evaluate evidence. Develop fair, consistent, and developmentally appropriate sanctions for violations of the code of student conduct.
– Issues oral and written admonishments or imposes sanctions pursuant to an administrative settlement agreement in which the student accepts responsibility for the misconduct.
– Exercise independent judgment and imposes appropriate sanctions up to and including disciplinary probation, or seeks the Associate Vice President’s approval in instances where suspension or expulsion is appropriate.
– Confer with CSUDH legal counsel to clarify law and policy expectations regarding student rights and responsibilities on a case by case basis. Maintain necessary confidential records as documentation of the student conduct process.
– Develop and implement selection process and training program for campus judicial hearing officers

15% – Respond to Disruptive Behavior and Assisting in the Resolution of Disagreements
– Support the CARE Team and other members of the University community who are seeking consultation and assistance in responding to disruptive or threatening student behavior in classrooms, department offices, University Housing or at University sponsored events or programs.
– Meet with members of the campus community who are experiencing conflicts with or between students.
– Assists in mediating disputes, undertakes various efforts to diffuse problems, and proposes appropriate solutions to conflicts. Inform parties of their rights and obligations, including the availability of campus complaint procedures.
– Recommend the implementation of interim suspensions when necessary to protect the health and safety and orderly operation of the campus. In conjunction with the Associate Vice President for Student Life/Dean of Students, prepares necessary documentation for Vice President of Student Affairs
– Support the Dean of Students and Manager of Student Support with the coordination of the CARE Team to support students in crisis.
– Work with Dean of Students on budget analysis and forecasting for programs and services

5% – Performs other duties as assigned
