Director, Ethics and Compliance (Americas)
The Ethics & Compliance Office (“ECO”) drives worldwide compliance with Company policies and directives and relevant government guidance and regulations.
The Director, Ethics and Compliance (Americas) supports the Chief Compliance Officer (“CCO”) in leading all aspects of the company’s ECO department with responsibility of the Americas, with the objective of meeting and/or exceeding government guidelines and industry standard methodologies.
Initiatives include coordinating compliance projects in the Americas in furtherance of global initiatives, including policy management and guidance, investigations, third-party management, and the monitoring and testing of compliance-related internal controls and processes (i.e., processes with a high risk of fraud, corruption or misappropriation of assets).
This role supports certain global initiative responsibilities.
How you would contribute:
Continue the development and implementation of a “best in class” global ethics and compliance program crafted to identify and mitigate legal and regulatory risk and propagate a culture of compliance and ethics throughout Herbalife’s worldwide business and operations.
Responsible and accountable for driving compliance with all elements of Herbalife’s Ethics & Compliance program in the Americas, including:
Lead day-to-day regional compliance efforts within the Americas, including review of high-risk vendors, charitable contributions, sponsorship events, interactions with government officials, etc.
Supervise compliance-related risk assessments and monitoring initiatives to identify key risks, and periodically evaluate compliance controls to ensure that they are operating to prevent and mitigate those risks; you will also help to ensure effective, regular monitoring and testing of relevant compliance controls
Perform root-cause analysis of compliance issues identified by investigations, internal audits, or monitoring activities, and develop and implement corrective action plans to resolve potential vulnerability and risks, and track remediation efforts
Lead local training and awareness campaigns to ensure awareness of and compliance with applicable laws and regulations and Company policies and procedures
Assist with global policy management effort by ensuring local policies track global polices.
Create country-specific addendums to global policies to address local compliance issues
Ensure global initiatives are executed within the region
Role will include certain Corporate/Global responsibilities, including:
Conduct investigations relating to policy non-compliance, as needed
Assist with drafting policies, where needed.
Provide compliance guidance and training to business partners relating to policy compliance and interpretation
Assist with efforts related to the third-party risk management program, such as leading improvements that streamline due diligence of high-risk vendors, improving the company’s continuous monitoring of high-risk vendors and driving global efforts to create risk ratings for all vendors
Other ECO assignments/initiatives as needed
Build and maintain a professional culture and team atmosphere
Provide leadership, mentoring, and development opportunities to ECO team
Perform additional duties as assigned
Skills and background required to be successful:
Skills:
Expert level knowledge of fraud, corruption and abuse issues and regulation designed to prevent/govern such issues
Self-starter, highly motivated and perseverance to achieve compliance goals
Ability to work independently, exercise good judgment, and take ownership of issues and matters to their successful conclusion
Expert level knowledge in developing, implementing, and leading global compliance program preferred
Strong leadership, influencing and interpersonal skills
Outstanding analytical, organizational and project management skills, including prioritization and time management
Sharp, clear, and concise oral and written abilities
Proven ability to motivate change with a large organization
Outstanding integrity and ethics
Strong quality and results orientation
Ability to solve practical problems and carry out responsibilities with limited supervision

Ability to adapt as the external environment and organization evolves
Ability to travel up to 10-15% of the time
Experience:
Minimum 10 years practical working experience in developing, implementing, and leading global compliance programs and the Foreign Corrupt Practices Act (FCPA) and the U.S.
Federal Sentencing Guidelines for organizations
Education & Certifications:
Bachelor’s degree in Business, Accounting or related fields
