Associate Counsel-Labor & Employment (Remote)

Career Description Job Description Candidate must be located in California. SUMMARY Reporting to the Vice President, Associate General Counsel and Chief Compliance Officer, you will partner directly with the Human Resources team and business functions to provide regulatory compliance and employment-related legal advice to the Company.This position requires California-specific employment law experience, including advising on state-specific employment law requirements, experience conducting internal investigations, defending PAGA claims and drafting state agency position statements. In addition, experience managing CA-specific employment-related class action litigation, as well as advising on CA Consumer Privacy Act/CPRA, Cal OSHA requirements (including COVID-19-related matters), CA-environmental regulations and other areas of compliance specific to CA regulations is preferred. RESPONSIBILITIES: Investigate and defend state charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents; Conduct internal investigations related to employment law and corporate compliance matters; Manage outside counsel in defense of CA-specific employment-related litigation, including class action litigation; Provide CA-specific environmental and safety-related compliance advice and counsel; Assist with triage and investigation of reports and inquiries to anonymous reporting line; Support senior labor attorney in implementation of union avoidance best practices and respond to potential labor organizing campaigns; Support data privacy team in driving compliance with California Consumer Privacy Act and California Privacy Rights Act Assist in development and presentation of education and training materials to HR and business stakeholders; Assist in employment-related aspects of company special projects such as mergers/acquisitions, as well as reductions in force and location closings (e.g., severance, WARN Act); Support preparation of materials for quarterly reporting up of employment law and compliance matters to senior executive leadership and Audit Committee. REQUIREMENTS: Minimum of five (5) years of employment law or legal compliance/regulatory experience Experience investigating and defending state charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents Experience with corporate compliance matters such as conducting internal investigations and/or managing anonymous reporting line Exceptional written communication skills Exceptional attention to detail, and strong organizational and problem-solving skills High level of interpersonal skills and ability to work in a proactive and service-oriented manner Excellent written and oral communication skills, including with remote stakeholders Ability to handle sensitive and confidential information Demonstrated ability to work on a variety of projects at the same time, to prioritize and to meet deadlines Self-starter with strong work ethic Some overnight travel may be required EDUCATION and EXPERIENCE: Juris Doctorate degree (J.D.) from an accredited law school required Five (5) years of employment law experience Retail experience preferred Bilingual (Spanish) preferred Law firm experience strongly preferred but not required LOCATION Remote-based in California
